Use agreement

For each photo permission release granted, the Photo Library prepares a use agreement which must be signed and returned by the end user prior to image release. Patrons may not reuse images in a different project without first contacting the Photo Library to expand or renew permissions and signing a separate use form.

Processing time

Please allow a minimum of ten working days for most digital image orders. Some requests may take additional time, depending on the size and complexity of the order. Contact the Photo Library directly if you have a rush order request and note your deadline in your order submission. The Photo Library makes every attempt to fulfill image requests in a timely manner, in a way that best meets the patron’s needs, but requests from Nebraska Game and Parks Commission employees are satisfied first and foremost, with outside requests completed as time allows.

Duration of loan

Final products that include approved digital images released by the Photo Library are often on display into perpetuity within the final, agreed-upon end version of a product (such as within a published book, calendar, video, brochure, website, or social media post). However, all other electronic versions of the images loaned must be completely and wholly removed from all electronic equipment used by the borrower within 90 days. The use of any image granted by the Photo Library is for one-time, non-exclusive reproduction only and can only be extended for further use upon the development of additional or expanded agreements. Neither Nebraska Game and Parks Commission staff nor public patrons may loan, give, or otherwise make available to any other organization or person any image provided by the Photo Library – to do so qualifies as copyright infringement. Patrons who violate this agreement will be fined accordingly.

Copyright

The majority of images published by the Nebraska Game and Parks Commission, including those appearing on the agency website, social media pages, in NEBRASKAland Magazine and other print and digital publications, are the sole property of the Nebraska Game and Parks Commission and are not available for publication by any other group, agency, organization, or individual without prior written agreement from the Photo Library. Some images used by the Nebraska Game and Parks Commission may be protected intellectual property not owned by the Commission, but used with permission granted by the rights holder. Contact the Photo Library to inquire about image ownership. While the Photo Library provides assistance in utilizing the Nebraska Game and Parks Commission photo collection, responsibility for obtaining permission related to images not owned by the Commission remains with the requester.

Right of refusal

The Photo Library reserves the right to refuse photographic requests from anyone not complying with the lending policies at any point in time, or for any request not aligned with the agency’s mission. Some images may be subject to an embargo and unavailable for release.

Fees

The Photo Library charges fees for both print orders and digital image use. Fees help offset the costs of digitization, handling, and any necessary adjustments made for color, size, or formatting. Invoices are prepared and sent upon completion of each order. Requests that require staff research or special librarian assistance may involve additional fees. Fees must be paid within 90 days of invoice, are non-refundable, and subject to change. The Nebraska Game and Parks Commission accepts cash, check, and credit card payments.
